08/111 CHAIRPERSON’S ANNOUNCEMENTS

The Chair announced that the school where Cllr Woodhead is Headteacher had recently received an Outstanding Ofsted report joining the top 10% in the Country. Action – Clerk to send letter of congratulations

08/112 TO APPROVE THE MINUTES OF THE ORDINARY MEETING OF THE COUNCIL HELD ON
21st October 2008

The minutes were approved and signed as accurate.

08/113 MATTERS ARISING FROM THE MINUTES
1. Vehicles causing obstructions in Village
A response has been received from Sgt Hunt concerning police powers when dealing with vehicles which are causing obstructions around the village. Sgt Hunt states ‘An obstruction can be dealt with by a uniformed police officer only by way of fixed penalty notice or report for summons if an offender refuses to accept a ticket. PCSO's cannot do either of these. PCSO's can visit and warn offending drivers though, or call up an officer (if available) to issue a ticket.
An obstruction has to be an actual as opposed to a potential obstruction for a ticket to be issued i.e it must be shown that someone was actually inconvenienced by the manner of the parking, and not just that someone was annoyed by the inconsiderate nature of it.
e.g a wheelchair user or pushchair user could not get past or that someone had to walk into the road to avoid the parked car.’

2. No Litter Signs on the High Street
An email has been received from N&SDC concerning the erection and design of No Litter Signs on the High Street and also the policing and revenue collection. The policing of the offence can be carried out by parish officers (not councillors) but training is necessary. All revenue goes to N&SDC. Action – Clerk to research cost and availability of no litter signs
3. Parkway Motors
N&SDC advise as follows: There is a 2 hour free parking period in the Mansfield Road car park, before a ticket can be issued the wardens have to note all the vehicles in the car park and then return 2 hours later and issue a ticket to any vehicle, not displaying a pass and which has been there for longer than the two hours. Invariably the wardens are seen inspecting the car park and all vehicles are removed. I will try and arrange another visit on a Friday night.
With regards to clamping the vehicles - The Parking partnership agreed that they would not resort to clamping in the County and N&SDC had previously decided not to introduce clamping.
4. No Parking Signs on High Street
An email was received from N&SDC who state signage on the High Street is being renewed shortly. It was reported some months ago that it was not valid since the islands had been introduced into the parking bays, each small bay now needs its own limited waiting sign. The wardens have been instructed not to issue tickets in the High Street.

08/115 PUBLIC PARTICIPATION/QUESTION TIME

The neighbourhood watch representative informed the council he had heard a rumour that there was to be a total ban of dogs on both Henton Road play areas. This ban has come from N&SDC. This field is used regularly by dog walkers who are responsible and clean up after their dogs and his concern was that if dogs are banned from the area the amount of dog fouling in the streets would increase.

The Chair replied that this item is on the agenda and will be discussed later in the meeting.

Mr Harrison, who has recently moved to the village, reported litter on the footpaths approaching the River Maun and traffic speeding on Mansfield Road.

The Chair replied that we are constantly in contact with the Highways Department concerning what can be done about the speeding vehicles. Action – Clerk to contact police to monitor situation; Cllr Benson suggested the Probation Service could litter pick along the footpaths although this is not a solution to the problem. Action – Clerk to contact Probation Service

A resident expressed his concerns stating that if the parking enforcement company are not looking at the issue of vehicles illegally parking around the village because they are working in Newark, then who will manage the situation on the High Street as it has to be the same authority and the police only act if there is an obstruction. Action – Clerk to monitor and liaise with N&SDC

08/117 ANY BUSINESS REMAINING FROM PREVIOUS MEETINGS
i. Website Statistics
Since the launch of the website we have received excellent feedback concerning from various sources. We have had messages from the Shetland Islands and Las Vegas! In October the website received 3,500 visits. Cllr Benham reported that he had problems when trying to print from the website. Action – Clerk to contact website company to try and sort the problem
ii. Community-Led Plan
It was agreed to leave until the Calor Village of the Year Competition was complete. Cllr Ward requested that we start the process in January/February 2009 as it will help with our entry in the competition. Agreed
iii. Village Hall Transfer
The Chair met with the Clerk of Works who has agreed to repair the faulty downpipe and re-plaster the interior wall before the transfer commences. The Chair asked the council if they agreed to a full structural survey – agreed unanimously. Cllr Ward expressed concerns over the condition of the windows and requested they are repaired.

RECEIPTS
• Agency payment of £2,291.08 was received from N&SDC for street sweeping
• £2,301.24 was received from Barratts as part payment of interest
• £600 was received from Robin Hood Colts as total contribution from 2007/8 season
PAYMENTS
• £85,093.83 was transferred to a high interest account – maintenance and upkeep of Sherwood Fields
• £4,000 was paid to Web Centre for the development of the new Edwinstowe Website. This money was from a grant received from EDP. The website management company has agreed to pay £500 for every website that is sold using the Edwinstowe template. The Clerk has advertised the website in the national Clerk magazine and two regional publications.
• £579.93 was paid to Village Hall Management Committee as contribution towards electrical work
CHRISTMAS – an interim budget shows that we are on budget for the Christmas Event
PAVILLION – An invoice has been received for business rates for £3,465 – this should be subject to discount Action – Clerk to investigate obtaining a reduction

2009/10 Precept decision – it was agreed at the Finance Meeting that the Precept would not increase next year and would remain at £94,592. Agreed unanimously


External Audit Report
The external audit has now been agreed and a copy of the report is available in the Council Chambers. The audit fee has increased due to the level of income and expenditure which is due to the building of the pavillion and also the section 106 monies from Barratts for the upkeep of Sherwood Fields.

08/121 TO RECEIVE REPORTS CONCERNING THE PARISH FROM COUNTY AND DISTRICT COUNCILLORS

District Councillor Moore met with Mike Keeling from Highways Department concerning various issues in the village; Mill Lane – the pavement, the lack of white lines, the overgrown holly bush. Mr Keeling is going to liaise with other departments and keep District Councillor Moore informed. Gaitskell Crescent – the condition of the pavement and has been reported. The footpath to Nursing Home on Mansfield Road – no progress concerning the footpath but currently looking at the possibility of improved lighting in the area.

Cllr Ward – Freedom of Information Act – The New Model Publication Scheme
All councils must produce a Publication Scheme which sets out the type of information that is available to view, how the information is published and details of any charges made. This Publication Scheme should be displayed in noticeboards and in prominent places. New guidelines have been received and Cllr Ward proposed that, ‘Edwinstowe Parish Council resolves to adopt the Freedom of Information Act New Model Publication Scheme without amendment.’ Agreed – unanimously
Making and Enforcing Byelaws Consultation
This is a consultative document regarding proposed new procedures enabling Local Authorities to make certain byelaws without the need for scrutiny by the Secretary of State and about the proposals for a new regime for byelaws. Due to the deadline for responses concerning the making and enforcing of byelaws, Cllr Ward reported that the Chair had made an executive decision to forward a positive reply to be retrospectively agreed at this meeting. Cllr Ward – Local Development Framework Key Decisions For Our Core Strategy
This report is N&SDC response to the amended Regional Strategy Plan as it affects the District Council’s previous Core Strategy Plan. No further comment is required by the Parish Council.

Approval of Revised Grant Application Policy – agreed unanimously. Cllr Benson stated that if grant applications were received from Charities they could come under Chairman’s Allowances and therefore would not be subject to the ‘every two years’ condition applied to general grant applications. Agreed unanimously. Cllr Bird requested that grants could be considered at every Ordinary Meeting and not just twice per year. Agreed unanimously Action – Clerk to amend wording on policy. N&SDC New Dog Exclusion Orders (Now include Fourth Ave play areas and both Henton Rd play areas) Concerns over the notification of new Dog Exclusion Orders from N&SDC which now includes both Henton Road play areas one of which is currently being used for dog walking. A discussion took place concerning the exclusion of dogs from the top play area where there is a dog bin. As residents have used this as a dog area for considerable time, it was felt that to exclude them would be incorrect. It was suggested that the area be changed to a ‘dogs on leads’ area instead and for relevant signs to be put in place. Action – Clerk to write letter to N&SDC to change designation on area and to also include Sherwood Fields as a ‘dogs on leads’ area.
Resident email Concerning condition of Edwinstowe News An email has been received concerning the unsightly appearance of Edwinstowe News. Numerous complaints have also been received in the Council Chamber. The Clerk has contacted Mike Hall and asked him to revisit the property to ascertain what can be done. Action – Clerk to contact Mike Hall, Environmental Health again. A discussion took place concerning what could be done to make the building look better especially concerning the forthcoming Village of the Year competition
